POLICY ON PROHIBITION OF DISCRIMINATION ON THE BASIS OF DISABILITY

The City of Middleburg Heights is committed to providing equal access to programs, services, and activities to persons with disabilities. The City of Middleburg Heights recognizes its obligation under the Americans with Disability Act (ADA) and the Fair Housing Act (FHA) to modify policies, practices, and procedures when necessary to ensure that people with disabilities are afforded an equal opportunity to participate in and access City programs, facilities, and activities; and to grant exemptions from enforcement of City ordinances and other laws or regulations, where such exemptions may be necessary to avoid discrimination on the basis of disability. The following is the City’s Policy on Prohibition of Discrimination on the Basis of Disability:

The City of Middleburg Heights will not discriminate against any individual on the basis of disability, including with regard to the full and equal enjoyment of its programs, services and activities. The City of Middleburg Heights will make reasonable modifications in policies, practices, or procedures, when the modifications are necessary to avoid discrimination on the basis of disability, unless the City can demonstrate that making the modifications would fundamentally alter the nature of its programs, services or activities. Possible modifications include, but are not limited to, granting exemptions from enforcement of City ordinances and other laws or regulations, where such exemptions may be necessary to avoid discrimination on the basis of disability.
