Our city government has the legal responsibility and authority to exercise regulatory control over land use, zoning and construction of all kinds in Middleburg Heights.

As our elected representatives, City Council exercises this authority. The City Planning Commission was created by our City Charter to assist City Council in making decisions regarding land use, zoning and construction in our community.

Membership

The Planning Commission consists of seven (7) members who are appointed by the mayor, with the approval of a majority of the members of City Council. The mayor, or his representative and one member of council may participate in commission proceedings as nonvoting members.

Meetings

The Planning Commission is required to meet at least once a month. Meetings are open to the public and are held at City Hall, 15700 Bagley Road, at 7:00 p.m. on the second and fourth Wednesdays of the month.

Duties & Powers

The Planning Commission is responsible for preparing, amending and maintaining:

  • Land subdivision regulations, while exercising control over the planning and subdividing of land within the city.
  • An official map of the city showing the present and planned systems of streets, public land and other public facilities, while making recommendations on developments. Zoning regulations and the zoning map, while making recommendations on proposed developments.

In addition:

  • The Planning Commission must review proposed zoning changes and post notice at City Hall and least once in a general circulation newspaper, of proposed changes in zoning regulations, or in the City Zoning Map. This notice must be posted and published at least ten (10) days prior to taking action on such matters.
  • The Planning Commission must inspect all sites that are proposed to be rezoned or redistricted.

Mandatory Referral

  • New construction, or changes in existing construction, for any public building, street, boulevard, parkway, park, playground, bridge, tunnel, or publicly or privately owned utility must be submitted to the Planning Commission for review and recommendation to City Council.
  • Proposed zoning changes must also be submitted to the Planning Commission for review and recommendation to Council.

Unless otherwise determined by City Council, the Planning Commission has 75 days in which to take final action on matters brought before it. If the Planning Commission fails to take action within the time allotted, it shall be deemed to have disapproved of such matter.

Public Hearings & Notices

The Planning Commission must hold public hearings when specified by the Zoning Code or by our City Charter. Notice of public hearings must be posted at City Hall at least 15 days prior to the hearing.

When required by the City Charter, notice of rezoning or redistricting proposals must be sent by mail to specified property owners.
